1. Introduction
These terms apply to your use of ozfinancegrouptec.online and to services provided by OZ Finance Group Pty Ltd (ABN 58 703 583 420, ACN 703 583 420) ("we", "us", "our"). By using the website or engaging us, you agree to these terms. Where we agree a written scope of work with you, that scope forms part of these terms and prevails to the extent of any inconsistency.
2. Our services
We provide general finance administration and business support, such as record-keeping, invoicing and payables administration, cash-flow organisation, budgeting support and preparing records for your advisers. The specific services, frequency and deliverables for an engagement are set out in the scope we agree with you.
Our services are not financial product advice, credit assistance, lending, or registered tax agent or BAS agent services. Content on this website is general information only and does not take into account your particular circumstances. You should obtain advice from an appropriately licensed or registered professional before making financial, tax or legal decisions.
3. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. Where the Australian Consumer Law applies, our services come with guarantees that they will be provided with due care and skill, be reasonably fit for any purpose you make known to us, and be supplied within a reasonable time.
If we fail to meet a consumer guarantee, you are entitled to the remedies set out in the Australian Consumer Law.
4. Fees and payment
Fees are agreed in writing before work begins. Unless otherwise agreed, invoices are payable within 14 days. We may pause work on an engagement while an invoice remains overdue, after giving you written notice.
5. Your responsibilities
You agree to provide information and records that are complete, accurate and on time, and to tell us promptly of any changes that affect the work. Our work relies on the information you supply; we are not responsible for errors that result from information that is incomplete or incorrect. You remain responsible for your own business decisions and for meeting your tax, legal and regulatory obligations.
6. Use of the website
You may use this website for lawful purposes only. You must not attempt to interfere with its operation or security. We aim to keep the content accurate and current but do not warrant that it is complete or free of errors, and we may change it at any time.
7. Intellectual property
The content, design and branding of this website are owned by or licensed to OZ Finance Group Pty Ltd and are protected by Australian intellectual property laws. You may view and print pages for personal or internal business use, but you may not reproduce or republish them without our written permission.
Your records and data remain yours. Reports and summaries we prepare for you may be used freely within your business; templates, methods and know-how we use to produce them remain ours.
8. Limitation of liability
Subject to section 3, and to the extent permitted by law:
- we are not liable for any indirect or consequential loss, or for loss of profit, revenue or data, arising from your use of the website or our services;
- where our liability for failing to meet a consumer guarantee can be limited, it is limited, at our option, to supplying the services again or paying the cost of having them supplied again;
- otherwise, our total liability in connection with an engagement is limited to the fees you paid us for that engagement in the twelve months before the claim arose.
9. Termination
Either party may end an engagement by giving 14 days' written notice by email. We may end an engagement immediately by written notice if you materially breach these terms and do not remedy the breach within 7 days of being asked to. On termination, you must pay for work completed up to the termination date, and we will return or securely make available your records, subject to any legal obligation to retain copies.
10. Privacy
We handle personal information in accordance with our privacy policy and the Privacy Act 1988 (Cth).
11. Governing law
These terms are governed by the laws of the State of Victoria (VIC), Australia. Each party submits to the non-exclusive jurisdiction of the courts of Victoria and the courts entitled to hear appeals from them.
12. General
If any part of these terms is found to be invalid or unenforceable, the rest continues in effect. We may update these terms from time to time by publishing a new version on this page; changes do not affect an engagement already agreed in writing unless you agree. Questions about these terms can be sent to [email protected].
